Our Costs/Fees

At S&J Pardesi Solicitors we always try to be clear, transparent and pragmatic about the costs/fees clients pay for our services.

Please see some of the details of our fees/costs charged below

Debt Recovery

Debt Recovery Against individuals

Our fees below are based upon standard non -contested/disputed debt claims for unpaid invoices.

In the event that the debt is contested/disputed or if the matter becomes protracted or complex then subject to your agreement and instructions the work that will need to be carried out on your behalf shall be charged on an hourly rate basis.

Debt Recovery Costings
The hourly rate charged for the professional legal services of Mr Gurmail Singh Pardesi- (Solicitor) is £240 plus VAT per hour.

Initial Pre-Action Letter (non-contested or disputed claims only)

Please note that once the Pre-Action Letter is sent out, the debtor will have an opportunity to contest or dispute the debt sum claimed. In the event that the debt sum is contested/disputed a separate fee estimate will be provided for any further work to be carried out.

Initial Pre-Action Letter
The sum of £120-£240 plus VAT is charged for an initial Pre-Action Letter (non-contested standard claims only) sent to an individual/sole trader on your behalf seeking payment of an outstanding amount/invoice together with any applicable interest.

Issue claim (non-contested or disputed claims only)

Should the debtor not respond to the Pre-action Letter or fail to dispute or contest the claim then we may following your instructions issue formal court proceedings against the debtor on your behalf.

Our fees are dependent on the value of the claim and are subject to reviewing limited documents and limited correspondence with you:

Our fees will be between £240-£480 plus VAT for a claim up to the value of £10,000.00 (Ten Thousand Pounds).

Our fees will be between £480-£720 plus VAT for claims exceeding the value of £10,000.00 and up to the value of £25,000.00 (Twenty Five Thousand Pounds).

Our fees for claims exceeding the value of £25,000.00 (More than £25,000.00) will be between £720-£1,200.00 plus VAT.

It is important that you note that our professional fees detailed above exceed the fixed recoverable costs under the Civil Procedural Rules.

You should also note that when issuing Court proceedings that a Court fee will be incurred by you in addition to our fees/costs estimate detailed above.

Depending upon the value of your claim the estimated Court fee to issue claims are set out on the pricing table.

Please note that should volume instructions be received being 5 or more  instructions per month over a 12 month period then revised costs/fees could be negotiated.

Landlord and Tenant Law

Fixed Fee For Residential Possession claims (non -contested or disputed claims only)

Our fees are £900 plus VAT to:

Draft the appropriate notice (single notice) seeking possession on your behalf, to review limited documents/papers, to draft and issue the claim for possession on your behalf, to draft your statement and attend the first/initial possession hearing (only) on your behalf either within Southampton, Portsmouth, Bournemouth or Basingstoke County Court. Please note that this fee will be charged subject to an initial review of the papers.

Our fee above does not include travel/parking costs or the Court fee cost estimated at £355 within the County Court which will be charged in addition.

Please note that should the claim for possession be contested or protracted or should upon reviewing the papers/documents it become clear that there has been a breach of legislation including the breach of deposit registration requirements or breaches of the Deregulation Act 2015, then a separate fee will be agreed with you for the work and following you instructions the work will be carried out on an hourly rate basis.

Fixed Fees to Draft Section 8 or Section 21 Notices Under the Housing Act 1988 as amended

Our fees are £240 – £480 plus VAT to draft a Section 8 Notice on your behalf under Section 8 of the Housing Act 1988 as amended.

This fee is subject to reviewing limited papers/documents and limited correspondence with you.

Our fee is £240 – £480 plus VAT to review limited documents and prepare a notice under Section 21 of the Housing Act 1988 as amended.

**Should it not be possible to draft the Section 21 notice following reviewing documents and due to non- compliance with legislation or regulations then a fee of £240 plus VAT will be charged.

It is important to note that subject to instructions, contested and disputed claims for possession will be charged on an hourly rate basis of £240 plus VAT.

Civil and Commercial Litigation

Civil and Commercial Litigation (contested and disputed claims)

Our fees in contested Civil and Commercial Litigation matters/cases will be charged on an hourly rate basis of £240 plus VAT per hour subject to a review of the papers and details of the particular case and on a case by case basis.

It is possible to agree fixed or capped fees throughout particular stages of Litigation.

It is important to note that in claims with a value of less than £10,000.00 (Ten Thousand Pounds)  it is rare to recover your legal costs and most cases only fixed legal costs are recovered. The recoverability of legal costs is complex and dependent upon a number of factors and S&J Pardesi Solicitors are happy to discuss this further with their clients on a case by case basis.

Insolvency Law

Statutory Demand

A Statutory Demand is a document prepared and served onto a debtor seeking payment of money. This document may be prepared before any action can be taken to file a Bankruptcy Petition against the debtor.

Fixed fees of £480 plus VAT are charged to prepare and serve a Statutory Demand. Our fees include personal service of the Statutory Demand usually charged at £50-£80 plus VAT and included within the £480 plus VAT fee.

Fixed Fee Bankruptcy Petitions

S&J Pardesi Solicitors charge a fixed fee of £1440 plus VAT to assist individual clients with their own Bankruptcy Petitions. Our fees/costs do not include Expenses/Disbursements such as the Court Fee or Official Receiver’s Deposit or Travel Costs to attend the initial Court Hearing on your behalf. These Disbursements/Expenses are charged in addition.

Additional Notes

Bankruptcy Petitions against debtors are charged on an hourly rate basis of £240 plus VAT per hour plus expenses/disbursements. Fixed fees/costs can be agreed for such matters/cases subject to a review of papers and/or through stages of the case.

S&J Pardesi Solicitors charge a fixed fee of £1680 plus VAT to assist clients with their own Company Winding Up Petitions. Our fees/costs do not include Expenses/Disbursements such as the Court Fee or Official Receiver’s Deposit or Travel Costs to attend the initial Court Hearing on your behalf. These Disbursements/Expenses are charged in addition.

Additional Notes

Winding up Petitions against debtors are charged on an hourly rate basis of £240 plus VAT per hour plus expenses/disbursements. Fixed fees/costs can be agreed for such matters/cases subject to a review of papers and/or through stages of the case.

Employment Law

Our fees in Employment matters/cases will be charged on an hourly rate basis of £240 plus VAT per hour subject to a review of the papers and details of the particular case and on a case by case basis.

It is possible to agree fixed or capped fees throughout particular stages of the Employment case, including fixed fees to prepare for and attend  a particular hearing by agreement.

Legal Expenses Insurance – You may have legal expense insurance provided by your home or motor insurer or there are insurance policies available which may help to cover your own fees and/or any possible responsibility for the other party’s legal fees.  It is your responsibility to provide all documentation to us to check this insurance policy to determine whether you are covered.

Damages Based Agreement – Under this agreementif you win your claim, solicitors’ fees (our fees/costs) are calculated as a percentage of the value of the compensation recovered on your behalf. We only offer these types of agreements in limited circumstances following a detailed review/assessment of the case.

Our fees in Personal Injury matters/cases will be charged on an hourly rate basis of £240 plus VAT per hour subject to a review of the papers and details of the particular case and on a case by case basis.

Road Traffic Accidents

 

Legal Expenses Insurance – You may have legal expense insurance provided by your home or motor insurer or there are insurance policies available which may help to cover your own fees and/or any possible responsibility for the other party’s legal fees.  It is your responsibility to provide all documentation to us to check this insurance policy to determine whether you are covered.

Contingency Fee Agreements (No Win No Fee Agreements) – Under this type of agreement, you do not pay our fees/costs unless your successful with your claim.  Should you be successful with your claim/case then some of your legal costs/expenses will be recovered from the other side and some of the legal costs will be subject to any agreement reached with you (from your compensation) or any agreement reached with your insurer. We may vary our methods of charging if special arrangements with you and/or your legal expenses insurer are agreed and made in writing. It should be noted that although you will not pay our fees if your not successful with your claim you may still be responsible for expenses / disbursements incurred in the case/matter.
